Weekly LRO Calendar for Updating Competitor Rents — Request from RVP Jay Blackman

“Comps” stands for competitors. This is where we called or visited our competing properties and made sure their current rents and specials were updated in RealPage LRO at least once a week. Some teams did it even more often—daily or multiple times per week. In my view, that is straightforward, black-and-white price fixing.

Mid-America Apartment Communities, Inc. (MAA) had me arrested on my son’s second birthday in retaliation for whistleblowing.

" I am reviewing the requirements and format of the reporting that will be submitted to the caller on that submission (you) and will get that posted back to the Whistleblower website before November 30.


I want to make sure I use the appropriate format/template for that report."

Baker Donelson has publicly promoted two “case studies” for Mid-America Apartment Communities, Inc. from 2015: a $400 million 4.000% senior notes offering through Mid-America Apartments, L.P., and an at-the-market equity offering of 4,000,000 MAA common shares. Those case studies are highlighted in their marketing materials as examples of the firm’s work for MAA.

Despite multiple requests to MAA, I have not been able to obtain any detailed written case study, underlying analysis, or supporting documentation for these matters. For something they chose to feature publicly, the absence of a complete, substantive write-up is notable.

​

The timing also raises questions, given MAA’s post-merger posture and the fact that MAA’s Executive Vice President and General Counsel previously worked at Baker Donelson. I again request that the full case studies and all related materials be provided.
